01.Acceptance of Terms
By downloading, installing, accessing, or otherwise using Gold Digger (the "Game"), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions in their entirety. These Terms constitute a legally binding agreement between you ("User") and Screwcap Games ("Company," "we," "us," or "our"). If you do not agree to these Terms, you must immediately cease use of the Game and uninstall any associated software.
You represent and warrant that you are at least 18 years of age. Use of the Game by persons under 18 is strictly prohibited. Screwcap Games reserves the right to modify these Terms at any time; continued use of the Game following any modification constitutes acceptance of the revised Terms. The Company may, at its sole discretion, suspend or terminate access to the Game for any violation of these Terms.
These Terms apply to all versions of Gold Digger, including free-tier access, Pro Pack ($2.99), and Expert Pack ($4.99) tiers distributed via Gumroad or any other platform. Purchase of a paid tier does not alter the scope of disclaimers or limitations of liability set out herein.
02.No Financial or Investment Advice
Gold Digger is built around simulated directional price calls on commodity and cryptocurrency markets — including gold, silver, crude oil, copper, natural gas, and bitcoin — purely for educational engagement and entertainment. This platform does not constitute investment advice, financial advice, trading advice, or any other sort of advice. You should not treat any of the platform's content as such, and no User should rely on it as the basis for any real financial, investment, or trading decision.
The Company is not a registered investment advisor, broker-dealer, futures commission merchant, or commodity pool operator under the Securities Exchange Act of 1934, the Commodity Exchange Act, or any comparable legislation in any jurisdiction. Nothing in the Game, including but not limited to simulated prediction outcomes, probability displays, leaderboard rankings, or AI-generated market commentary, should be interpreted as a recommendation to buy, sell, hold, or otherwise transact in any financial instrument.
Past simulated performance within the Game is not indicative of future real-world results. The risk of loss in actual trading of commodities and cryptocurrency can be substantial. Certain jurisdictions impose additional restrictions on prediction markets and financial simulations; it is the User's sole responsibility to determine whether accessing and using this Game complies with the laws of their jurisdiction.
Consult a qualified financial advisor, commodity trading advisor, or other licensed professional before making any real-world investment or trading decision. The Company explicitly disclaims any responsibility for financial losses incurred by Users who apply Game mechanics, outcomes, or insights to actual markets.
03.Simulated Environment
All price calls, outcomes, scores, and leaderboard rankings within Gold Digger are generated within a simulated environment and do not represent actual investment positions, trades, or returns. Simulated and paper trading results have certain inherent limitations: unlike actual trading, simulated results do not reflect real market liquidity, slippage, transaction costs, counterparty risk, or the emotional and psychological pressures of real capital deployment. No representation is made that any User account balance, score, or rank reflects or would reflect results achievable in live markets.
The prediction market mechanics within Gold Digger are modelled on publicly observable market structures for educational reference only. The Game does not facilitate real wagering, real financial transactions between players, or any form of real-money prediction market participation. Any in-game currency, points, or virtual assets have no real-world monetary value and cannot be redeemed, exchanged, or withdrawn.
References to Polymarket or similar prediction market platforms within the Game are provided solely as educational context to illustrate how real-world prediction markets function. Gold Digger is not affiliated with, endorsed by, or operated in partnership with Polymarket. No User action within Gold Digger constitutes participation in any Polymarket market, and no Gold Digger outcome affects any external platform position.
HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT BEEN EXECUTED, THE RESULTS MAY HAVE UNDER- OR OVER-COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN.
04.Data Sources & Accuracy
Gold Digger incorporates market data sourced from Yahoo Finance (subject to a minimum 15-minute delay), Polymarket public market data, and the Federal Reserve Economic Data (FRED) API. This data is provided for informational and educational purposes only and is presented as-is. Market data may be delayed, incomplete, inaccurate, or subject to interruption at any time without notice. The Company makes no warranty, express or implied, as to the accuracy, timeliness, or completeness of any data displayed within the Game.
Screwcap Games is not affiliated with, sponsored by, or in any formal data relationship with Yahoo Finance, Polymarket, or the Federal Reserve Bank of St. Louis. Use of data from these sources is subject to the respective terms of service and data licensing agreements of each provider, and the Company's ability to serve this data may be modified or terminated at any time due to changes in those third-party terms. The Company accepts no liability for any data errors, omissions, or service interruptions originating from third-party data providers.
Price data displayed in the Game may differ from data available on other platforms due to delays, rounding, data-source selection, or normalisation processes applied for display purposes. Users must not rely on in-game price data for real-time trading decisions. The Company explicitly disclaims any liability arising from a User's reliance on in-game data for any purpose other than engaging with the Game's simulated prediction mechanics.
05.User Conduct
Users agree to access and use Gold Digger for lawful purposes only. You must not attempt to reverse-engineer, decompile, disassemble, or otherwise exploit the Game's software, algorithms, or data pipelines. You must not attempt to manipulate leaderboards, exploit data feeds, automate User interactions, or otherwise undermine the integrity of the simulated game environment. Any such conduct may result in immediate account termination without refund.
Users must not use information derived from the Game — including but not limited to aggregated player sentiment, prediction distributions, or model-implied probabilities — as the basis for actual market positions, financial products, or services without the express written consent of Screwcap Games. Redistributing, publishing, or commercially exploiting any Game data, scores, or content without authorisation is prohibited.
The Company reserves the right to modify, suspend, or discontinue any feature of the Game, including leaderboard data, at any time without prior notice or liability. Paid tier purchases are subject to Gumroad's refund policies; the Company's own refund policy, if any, will be set out at the point of purchase.
06.Intellectual Property
Gold Digger, including its software, source code, trade name, visual design, scoring algorithms, character assets, audio, written content, and all associated materials, is the exclusive intellectual property of Screwcap Games and is protected under applicable copyright, trademark, and trade secret laws. All rights not expressly granted herein are reserved. Purchase of a paid tier grants the User a limited, non-exclusive, non-transferable licence to access the Game for personal, non-commercial use only.
Third-party trademarks, data provider names, and market identifiers referenced within the Game are the property of their respective owners and are used solely for descriptive, educational, and reference purposes. Such references do not imply endorsement of Gold Digger by those third parties, nor do they imply that Screwcap Games has any affiliation, sponsorship, or licensing relationship with them beyond publicly available data access.
Users may not reproduce, distribute, publicly display, create derivative works from, or otherwise exploit any portion of the Game without prior written authorisation from Screwcap Games. Any feedback, suggestions, or ideas submitted by Users regarding the Game may be freely used by the Company without obligation or compensation to the User.
07.Limitation of Liability
To the maximum extent permitted by applicable law, Screwcap Games, its officers, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of, or inability to use, Gold Digger. This limitation applies regardless of the legal theory under which such liability is asserted, including contract, tort, negligence, strict liability, or otherwise, and even if the Company has been advised of the possibility of such damages.
Without limiting the foregoing, the Company expressly disclaims all liability for: (a) financial losses of any kind incurred by a User who applies Game outcomes, mechanics, or content to real-world trading or investment decisions; (b) inaccurate, delayed, or missing market data from third-party sources; (c) interruptions, outages, or errors in data feeds from Yahoo Finance, Polymarket, FRED, or any other third-party provider; (d) loss of saved progress, leaderboard standing, or purchased content due to technical failure. The Game is provided "as is" and "as available" without warranty of any kind.
In no event shall the Company's aggregate liability to any User for all claims arising from or relating to the Game exceed the total amount paid by that User to Screwcap Games in the twelve months preceding the event giving rise to the claim, or USD $10.00, whichever is greater. Some jurisdictions do not permit the exclusion of certain warranties or limitation of liability; in such jurisdictions, the Company's liability shall be limited to the maximum extent permitted by law.
08.Indemnification
You agree to indemnify, defend, and hold harmless Screwcap Games, its principals, officers, employees, agents, and successors from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of or access to the Game; (b) your violation of these Terms; (c) your violation of any applicable law, regulation, or third-party right; or (d) any real-world financial decision you make that is informed or influenced by your experience with the Game.
This indemnification obligation shall survive the termination of these Terms and your cessation of use of the Game. Screwcap Games reserves the right to assume exclusive control of the defence of any claim for which indemnification is sought, in which case you agree to cooperate fully with the Company in asserting any available defences.
09.Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Game shall be resolved by binding individual arbitration administered under the rules of the American Arbitration Association, and not through class action, collective proceeding, or jury trial.
Any arbitration shall take place in Delaware, or at the mutual agreement of the parties via remote hearing. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction in Delaware to protect intellectual property rights or prevent unauthorised use of the Game. You waive any right to participate as a plaintiff or class member in any class action proceeding relating to the Game or these Terms.
If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. These Terms constitute the entire agreement between the User and Screwcap Games with respect to Gold Digger and supersede all prior agreements, representations, and understandings.
